In Summary

  • Quotations are valid for 28 days only
  • A minimum of 50% deposit will be required before any work can commence
  • Clients requiring maintenance work will require a 60% deposit unless they have a Maintenance Agreement with Boost Digital Media Ltd
  • The initial deposit of 50% is none refundable
  • Additional works will be carried out, but charged at our standard hourly rate.
  • All payments should be made to Boost Digital Media Ltd within 7 days
  • Payments not received within 28 days from date of invoice will be subject to interest set at 13% per month
  • Late Payers may have their websites disabled or work removed at their expense until payment is made
  • Project delays as a result of client action or inaction may be subject to additional costings.

The Full T’s and C’s

  1. Contract
    The client’s approval for work to commence shall be deemed a contractual agreement between the client and Boost Digital Media Ltd and acceptance of these terms and conditions.
  2. Intellectual Copyright
    Boost Digital Media Ltd  will hold all intellectual copyright of any material including any source code, created for the client until payment of the final invoice.  At this time it will become the property of the client.
  3. Registration Charges:
    All third party costs arising from the registration of domain names, acquiring of stock photography, premium plugins or any other cost shall be met by the client.  Boost Digital Media Ltd will register domain names on behalf of the client in the clients name and costs of this registration will be met by the client.
  4. Search Engine Optimisation (SEO):
    During the design and build of the website Boost Digital Media Ltd  is not responsible for the client’s on-going website promotion. Should the client require the site to be promoted on an ongoing basis a separate contract must be drawn up.  The order in which websites are ranked in the natural results are controlled by the search engines. Whilst we may optimise your website for this we are unable to make any guarantees of its success of any search engine promotion activity. 
  5. Design & Approval: 
    Once we have taken a brief from the client we will then produce a series of designs based on this.  Initially we will produce 2 home page designs. You will need to choose one of these 2 designs for your home page and a further 2 designs will be created 1 of these will be for standard page and the other will be for the contact page website.  

    Should you require additional designs or if you are not happy with any of the 3 designs provided an additional charge will be added.  This charge will be at the set rate of £60.00 for each additional design carried out.

    You will be advised about at the time and only applies to clients who are not happy with any of the designs produced or would like additional design templates produced.  
  6. Cancellation:
    Should the client wish to cancel then you are free to cancel at any point of the process, however the client will remain liable for any work carried out and shall be invoiced accordingly. 
     
  7. IMPORTANT Failure to Provide Website Content:
    We are small but busy digital agency.  To remain as efficient as possible we must ensure that work we have programmed is carried out at the scheduled time.  On occasions we will reject other work and enquiries to ensure that your work is carried out and completed on time.

    This is why it is vital that you provide all the require information in advance.  On any occasion where we cannot progress with your website because you have not provided the required information when you have agreed to do so, and we are delayed as a result, we reserve the right to impose a surcharge of up to 25%.

    Also, if your job involves Search Engine Optimisation (SEO) we need the text content for your site up front so that the SEO can be planned and completed efficiently.  

    If you agree to provide us with the required information and subsequently fail to do so within four weeks of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. 

    Simply put all the above condition says, is not give us the go ahead to start until you are ready to do so.

    Note: Text content should be delivered as Microsoft Word (or similar) document with pages in this document representing the content of the relevant pages on your website.  Images should be delivered in high resolution JPEGS or similar. The content titles should match up with your website pages. Contact us if you are unsure
  8. Website Amends
    The client can make up to 5 rounds of amends per template during the design stage of the website.

    Changes made to the layout or the design after the design phase will be billed at our hourly rate.

    Boost Digital Media Ltd  will apply a charge in the event the client makes changes to the layout that was not included or approved in the design phase of the process.  We will charge an additional design fee if we have to approach our design team and a separate development fee for creating the new template.

    All amends need to be made before the website goes live, content amends are down to the clients, unless you have requested for us to quote for content to be added to the website on top of development of your website.
  9. Testing Server
    Once we have produced a working version of your website on our localised machines we will upload your website to our testing server.  Your website will reside inside a subdirectory which will be provided to you for you to view.  

    The purpose of the testing server is to provide you with a working version of the website and for you to add any content that you may have.  You can also use this time to begin playing with the content management system.

    The client is responsible for the testing of their own websites.
  10. Travel Time and Expenses
    Travelling time to and from a customer premises is generally not included in our estimate and as such Boost Digital Media Ltd  reserve the right to make a charge for travelling time at our normal consultancy rates. Boost Digital Media Ltd reserve the right to charge for travelling expenses based on 45p per mile.
  11. Quotations:
    All quotations are limited to 28 days net.  Should the client decide to change the requirements of the brief during the build a separate quote and price will be drawn up for the works.  Where it isn’t possible for Boost Digital Media Ltd to produce a separate quote for the works, the client understands that the works will incur further costs and this will be added to the final invoice as a result. 
  12. Advance Payment:
    An advanced payment of 50% of the total cost is required before work can commence on your project.  After work commences this is none refundable.
  13. Payment Terms
    Strictly 7 days from date of invoice. Payment is currently accepted via BACS, Cheque or Cash this is to be in UK Pounds sterling only.  If you are paying via cheque we will charge an additional 1.5% processing fee and if the bank returns your cheque as unpaid for any reason we will add an additional charge of £48.00 Cheques should be made payable to Boost Digital Media Ltd.
  14. Credit Card Payments:
    You are welcome to pay via Credit Card this will be done via our electronic PayPal invoice system or through our Stripe card payment terminal.
  15. Payment
    Payment of any balance will be due within 7 days of our invoice date.  Full publication of any web pages may only take place after full payment has been received.  Any material published may be removed if payment is not received. When this occurs a minimum charge of £50 will be required to have the website restored. 
  16. Late or none payment
    If you know your payment is going to be late, please let us know.  Accounts that have not settled their balance in full within 7 days will incur a late payment charge of 10% of the value outstanding. You will also be charged a statutory interest of 13% per month.

    Your website may also be disabled as a result.
  17. Training
    You will not be trained on how to use the system, this can be arranged and will be regarded as an additional service and will require prior arrangement .
  18. Future Support
    The website that is produced by Boost Digital Media Ltd  is accepted by the client as a full functioning, completed piece of work.  Boost Digital Media Ltd is not responsible for the future support maintenance of the website.  If you would like your website maintained by Boost Digital Media Ltd a separate Maintenance Agreement will need to be drawn up and the appropriate monthly fee applied.  No guarantee of future support is given.
  19. Future Site Problems
    Unfortunately in today’s connected world, malicious software, spyware, viruses and website hacking are facts of life on today’s Internet.  It is highly unlikely that these will affect your website and Boost Digital Media Ltd will endeavour to protect it from this as much as we can during its creation, but we cannot be held responsible for problems that develop on sites after we have handed them over to the client

Notes:

Should Boost Digital Media Ltd  waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit Boost Digital Media Ltd  to waive the same clause on any other occasion.

We reserve the right to alter these terms and conditions without prior notice.
